Abstract
It is indisputable that the criminal law makes an effective contribution to achieving social stability by confronting acts of aggression against the social system, in addition to contributing to the consolidation of social development through what it does to advance society towards the world of progress and development, and perhaps the development taking place in the overall life reflects the criminal law - As a social law - it must take this into account in the course of its penal texts, which is what sparked these lines. The existence of the criminal law seeks to take a realistic view of the social system and the great burden that system places on it. To focus the role of the criminal law in the field of criminalizing substandard content, we say: The truth of the issue is limited to an assumption based on the extent to which the Iraqi criminal legislator has implicitly adopted this idea in the penal code, which is the problem raised here, aside from the guidance that the criminal judge takes to develop solutions to it, as The increasing importance of this topic day after day due to its widespread frequency across the electronic system was a real motivation to contribute to addressing it and determining its criminal path.
