Abstract
One of the most important rights of children over fathers is to establish their paternity from their father in order to protect them from loss and humiliation, and every human being must have paternity belonging to him and organized under his shadow and to say otherwise exposes the human being to humiliation and contempt by society.
The Islamic legislator as well as the positive legislator sets ways to prove descent and these conditions or methods stipulated by the Iraqi legislator in the Personal Status Law No. 188 of 1959, as amended, and limited them to two roads, namely the bed road and the way of recognition. But with the advancement of science and technology, we have come up with modern methods by which descent can be established by examining (DNA) which is known as a genetic fingerprint.
