Abstract
One of the established human rights is the right to the safety of his mental and physical health. It is one of the rights that most legal constitutions or legal texts included in those laws that are concerned with protecting the human right to his physical, mental and psychological health stipulate, especially since the issue of public health is a fundamental focus for every individual in society, and without it, his life cannot be straightened out and he cannot perform his duties. Therefore, it was imperative for countries, through their legal legislation, to secure means of protecting public health from the various risks it faces. In light of the increasing development of technology in various areas of life, it has become easy for anyone who dares to tamper with the health of individuals in society by promoting or selling spoiled and expired medicines, whether related to the treatment of ordinary or incurable diseases that are difficult to obtain from government pharmacies affiliated with government health institutions. Individuals resort to pharmacies affiliated with the private sector to obtain medical supplies, and these pharmacies are constantly increasing, and the drug trade is almost one of the most profitable sectors. It is a booming trade in our time, especially if these medicines are expired and the production and expiration dates have been tampered with. Instead of destroying them, they are sold to individuals, causing them health, physical and psychological damage. This in itself constitutes an assault on the citizen’s right to public health. Despite the legal texts addressing the crime of selling expired medicines and the legal responsibility of individuals who commit these acts, this phenomenon is still widespread in some pharmacies. This is a violation of the provisions of the law. Therefore, the role of real oversight must be activated in following up on the validity periods of medicines and destroying them after they lose their validity, because their use may lead to the death of those who take them. Therefore, the laws related to criminalizing the sale of expired medicines must be implemented and the role of government oversight must be strengthened in limiting their spread.
