Abstract
This research deals with an innovative approach in criminal law, which is to adopt reconciliation as a means to recover funds smuggled abroad as a result of corruption crimes, instead of resorting to traditional penalties. This approach is based on the principle of consent and aims to reduce the burden on the judiciary, seeking to resolve criminal cases without the need for penalties, while prioritizing the financial interest of the state over the right of society to punish perpetrators. The research is divided into two sections: the first deals with the concept of public money and criminal reconciliation in Iraqi legislation, while the second reviews the role of criminal reconciliation in achieving restorative justice in smuggled money cases.
