Abstract

The marital relationship represents the most advanced mechanism for human control in dealing with private life, and its establishment on legitimate and legal rules helps to give this relationship stability and avoid crises, and keep married life away from disintegration, violation and loss. The marital relationship is also the basis for building the family that forms the nucleus of society and its stability. The success of this relationship is determined by the extent of the spouses' commitment to the rights and duties stipulated in the laws and legislation regulating it. It will represent an important area for research, as we must explore the values ​​and concepts that form the basis for this relationship and how to apply them within the framework of the family, and form a sound marital relationship based on love and mutual respect. The research aims to study the legal framework necessary to regulate relations between spouses, and determine their impact on the stability of the family and society by analyzing the legal texts governing marriage and the social effects resulting from it, to provide a safe and stable environment. The legal framework of the marital relationship includes a set of rules derived from Islamic law and positive laws that regulate this marriage, the rights and duties between spouses, and the provisions of divorce and alimony, which directly affect family stability and limit cases of disintegration, collapse and loss. Therefore, this legal framework for this relationship is considered a fundamental factor in achieving stability and security, as it sets controls that regulate marital life to ensure the protection of the rights of both parties. Accordingly, updating the laws in accordance with the requirements of contemporary society and enhancing the culture of legal awareness among spouses contribute to strengthening family ties and stability, which is positively reflected on society as a whole. The research aims to shed light on the effects that the marital relationship leaves on the family and society and ways to achieve stability.
